Terms of Service

Plain terms for a plain product: you own your data and your users' data, we run the service, and we tell you before anything important changes.

  1. 1.Agreement

    These Terms are a contract between you and Firat Tamur, who operates SuggestKit ("we", "us"). By creating an account, installing the SDK or using the service you agree to them. If you use SuggestKit on behalf of a company, you confirm you have authority to bind that company, and "you" means the company.

    If you do not agree, do not use the service.

  2. 2.The service

    SuggestKit lets you collect feature requests from your users through an embeddable widget and SDK, weight each request by the plan and revenue of the people asking, triage requests on a board, and notify voters when something ships. We may add, change or remove features over time. We will give reasonable notice before removing a feature you rely on.

    The service is currently in public beta. It works and we run it carefully, but you should expect rough edges and occasional changes.

  3. 3.Accounts

    To use the service you must:

    • Be at least 18 years old, or the age of majority where you live.
    • Give accurate account details and keep them current.
    • Keep your password and API keys secret. Anything done with your keys counts as done by you.
    • Tell us promptly if you believe your account has been compromised.

  4. 4.Your customers' data

    When you call identify() or your users post through the widget, you send us personal data about your own users ("end-user data"). Between you and us, you own that data and you are its controller. We are your processor. This section is our data processing agreement, and we commit that:

    In return, you confirm that you have a lawful basis to share end-user data with us, that your own privacy notice covers this processing, and that you will not send us data you are not allowed to share. Do not send payment card numbers, government identifiers, health data or other special-category data through the SDK; the service is not designed to hold them.

    • We process end-user data only to provide the service to you and only on your instructions, which are these Terms and your settings in the dashboard.
    • We keep it confidential, protect it with the measures described in our Privacy Policy, and require the same of our subprocessors.
    • We delete or return it when you delete a project or your account, as described in the Privacy Policy.
    • We help you respond to your users' privacy requests and to a security incident affecting their data.
    • We do not sell end-user data or use it for our own purposes beyond running and securing the service.

  5. 5.Acceptable use

    You may not:

    We may suspend an account that does any of this, after contacting you where practical.

    • Break the law, or infringe anyone's rights, using the service.
    • Upload malware, or try to breach, probe or overload our systems.
    • Scrape, resell or sublicense the service, or reverse engineer it beyond what the law allows.
    • Use the widget to collect data from people who have not agreed to your own terms and privacy notice.
    • Post or allow content that is abusive, defamatory or spam, or use the notification features to send unsolicited messages.
    • Share one account or seat between several people.

  6. 6.Plans, trials and billing

    The Free plan is free for as long as we offer it. For paid plans:

    While billing is in beta, prices shown on the site are placeholders and no card is charged.

    • Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled.
    • New paid subscriptions start with a 14-day free trial. You will not be charged if you cancel before the trial ends.
    • You can cancel any time from the billing page. Cancellation takes effect at the end of the current period, and we do not refund partial periods except where the law requires it.
    • If you exceed the posts, projects or seats included in your plan we will ask you to upgrade; we will not charge overages without your agreement.
    • We may change prices with at least 30 days' notice by email. The change applies from your next renewal after the notice period.
    • Prices exclude VAT and other taxes, which we add where we are required to collect them.

  7. 7.Content and ownership

    You keep all rights to the content you and your users put into the service. You give us a licence to host, store, process and display that content only as needed to run the service for you. Feedback you send us about the product itself may be used freely.

    We keep all rights to SuggestKit, including the SDK, widget, dashboard, brand and documentation. You get a non-exclusive, non-transferable licence to use them while you have an account, subject to these Terms. Our SDK may be open source under its own licence, which then governs the SDK code.

  8. 8.Availability

    We aim for the service to be available all the time, but we do not promise uninterrupted service during beta. We will announce planned maintenance in advance where we can. Business plans include an uptime commitment set out in the order form for that plan.

  9. 9.Termination

    You can close your account at any time from the account page. We may end these Terms with 30 days' notice, or immediately if you materially breach them and do not fix the breach after we ask, or if we stop offering the service.

    When the account closes, your access ends and your data is deleted as described in the Privacy Policy. You may export your feedback data before closing. Sections on ownership, disclaimers, liability and governing law survive termination.

  10. 10.Disclaimers

    The service is provided "as is". To the extent the law allows, we disclaim all warranties, including that the service will be error-free or fit for a particular purpose. Revenue figures in SuggestKit are computed from the data you send us; they are an aid to prioritisation, not financial advice, and we are not responsible for decisions you make based on them.

  11. 11.Limitation of liability

    To the extent the law allows, neither party is liable for indirect, consequential or special damages, or for lost profits, revenue or data. Our total liability under these Terms is limited to the amount you paid us in the 12 months before the claim, or 100 US dollars if you paid nothing. These limits do not apply to a party's breach of the data section above, to its indemnity obligations, or to liability that cannot be limited by law.

  12. 12.Indemnity

    You will defend and indemnify us against third-party claims arising from content you or your users submit, from end-user data you send without a lawful basis, or from your breach of these Terms. We will defend and indemnify you against third-party claims that the service, used as permitted, infringes their intellectual property.

  13. 13.Changes to these Terms

    We may update these Terms as the service evolves. For material changes we will email account holders at least 14 days before the change takes effect. Continuing to use the service after that date means you accept the new Terms. If you do not, you may close your account before the change applies.

  14. 14.Governing law and general

    These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, and disputes will be resolved in its courts. If you are a consumer, nothing here removes protections you have under the law of the country where you live.

    If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between us about the service. Contact: support@suggestkit.app.
